These Terms & Conditions (“Terms”) apply to all use of the website and webshop operated by Marché Noir, a business established in Belgium. By accessing our website or placing an order through our Shopify store, you agree to be bound by these Terms.

These Terms apply to all offers, orders, agreements, and deliveries of products sold through the Marché Noir webshop, unless explicitly agreed otherwise in writing.

3. Products & Descriptions

  • Marché Noir sells second-hand clothing exclusively.

  • All items are unique and available in limited quantities.

  • Product descriptions, photos, and measurements are provided as accurately as possible.

  • Minor imperfections, signs of wear, or aging are inherent to second-hand items and do not constitute defects.

4. Prices & Payments

  • All prices are listed in euros (€) and include applicable VAT, unless stated otherwise.

  • Shipping costs are displayed separately during checkout.

  • Payments are processed securely via Shopify-supported payment providers.

  • Marché Noir reserves the right to correct pricing errors and cancel orders resulting from obvious mistakes.

5. Orders & Acceptance

  • An order is considered final once payment has been successfully completed.

  • Marché Noir reserves the right to refuse or cancel orders in cases of suspected fraud, abuse, or errors.

  • Order confirmation emails do not constitute acceptance if errors are present.

6. Shipping & Delivery

  • Shipping is subject to the Shipping Policy available on the webshop.

  • Delivery times are indicative only and not guaranteed.

  • Risk of loss or damage transfers to the customer once the order has been handed over to the carrier, in accordance with applicable law.

7. Returns & Right of Withdrawal

  • Consumers have a statutory right of withdrawal within 14 days of receipt, in accordance with EU law.

  • Returns are subject to the Return & Refund Policy available on the webshop.

  • Return shipping costs are borne by the customer unless otherwise required by law.

8. Liability

  • Marché Noir shall not be liable for indirect or consequential damages, including loss of profit or data.

  • Liability is limited to the purchase price of the product concerned, except where prohibited by law.

  • Marché Noir is not liable for damage caused by misuse, improper handling, or normal wear and tear.

9. Force Majeure

Marché Noir shall not be held liable for failure to perform obligations due to events beyond its reasonable control, including but not limited to strikes, pandemics, natural disasters, government actions, or carrier delays.

10. Intellectual Property

All content on this website, including text, images, logos, and designs, is the property of Marché Noir or its licensors and may not be used without prior written consent.

11. Privacy

The processing of personal data is governed by our Privacy Policy, available on the webshop.

12. Governing Law & Jurisdiction

These Terms are governed by and interpreted in accordance with Belgian law.

Any disputes shall be submitted to the exclusive jurisdiction of the competent courts of Belgium, unless mandatory consumer protection laws provide otherwise.

13. Amendments

Marché Noir reserves the right to modify these Terms at any time. The version in force at the time of the order shall apply.
